General Competition Terms
1. GENERAL COMPETITION TERMS
Each Competition is offered by the Kinetic Foundation, a charity registered in England & Wales with registration number 1151315, whose registered office is 5 Robin Hood Ln, Sutton. SM1 2SW.
By entering a Competition, you will be deemed to have accepted: (a) the relevant Specific Rules; and (b) these General Competition Terms. If any Specific Rules conflict with the General Competition Terms the Specific Rules will prevail.
Any decision of the Kinetic Foundation in respect of a Competition is final. For questions regarding a Competition, please contact the Kinetic Foundation.
2. ENTRY CONDITIONS / RESTRICTIONS
Kinetic Foundation employees or an intern, contractor, sponsor or agent of the Kinetic Foundation or its group companies, anyone professionally connected with this Competition, or an immediate family member of any of the foregoing is not eligible to enter the Competition. Entries from any of the foregoing will not be eligible to win a prize.
To enter, you must follow the entry process for the Competition, which will be explained in the Specific Rules and/or promotional materials or announcements. The Kinetic Foundation cannot guarantee entry (and accept no responsibility for) entries which are mis-spelt, corrupt or ineligible, or for entries which haven’t reached us – for example, postal, telephone, text message, online or social media entries not received as a result of network incompatibility, technical faults or for any other reason.
Bulk entries, entries by third parties or agents, syndicated entries, entries made via automated devices, or entries made using methods such as, without limitation, a computer macro or script will not be eligible to win a prize.
No entries received after the Close Date will be eligible to win a prize.
If you are ineligible to take part in the Promotion (e.g. because of age restrictions or previous exclusions), your entry cannot be transferred to anyone else. If the Kinetic Foundation discovers that you are ineligible to take part, you may be disqualified. The Kinetic Foundation reserves the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
3. PRIZE CONDITIONS
The prize does not include, and the Competition winner is solely responsible for, all costs and expenses associated with participation in the prize (such as, without limitation, internet use, and all required equipment for participation).
Should the prize for a Competition be unavailable, the Kinetic Foundation has the right to substitute it for a prize of equal or greater value.
Prizes may not be resold, are non-transferable, non-refundable, non-redeemable for cash or other goods or services.
Unless otherwise agreed in writing by the Kinetic Foundation, the prize will only be awarded to the winner.
Any images of the prize are illustrative only and may not show the exact prize to be won.
Certain rewards and prizes may or may not be limited by geographical location
4. PUBLICITY
Each winner agrees to participate in reasonable publicity as may be required by the Kinetic Foundation in respect of the Competition.
Within a year of the Close Date and only in respect of the Competition, the Kinetic Foundation reserves the right to publish each winner's name, photograph and country on its website and/or any social media or streaming platform or to otherwise publicise the winner.
5. PARTICIPANT VERIFICATION AND DISQUALIFICATION RIGHTS
The Kinetic Foundation reserves the right, in its absolute discretion, to verify the eligibility of any participant, including, without limitation the participant’s age and parental consent, where required.
The Kinetic Foundation reserves the right, in its absolute discretion, to disqualify a participant:
found to be abusing or tampering with the operation of the Competition;
who enters the Competition using fraudulent means;
who enters the Competition using incorrect contact details;
who enters the Competition on someone else’s behalf; or
who the Kinetic Foundation reasonably believes has acted in breach of these General Competition Terms.
6. WINNER SELECTION
Winner(s) will be selected as explained in the Specific Rules. This will be done by either (a) a random automated process, or (b) a process which will be conducted or supervised by an independent person, or (c) such other process as explained in the Specific Rules.
If you win a prize, You will need to respond to the notification within the timeframe set out in the Specific Rules (this will be no later than 28 days following the date of our notification if no timeframe is set out in the Specific Rules), and follow the instructions provided to you. You will need to provide proof of your ID, age and address for your prize to be delivered.
7. PRIZES
Any tax or other charge payable in conjunction with the prize will be your sole responsibility. If this is of concern you should speak to a financial advisor.
The prize or prizes will be as described in the relevant Specific Rules. Imagery is for illustrative purposes only, and colours and other minor details may vary.
Third party terms and conditions may apply to certain parts of a prize, where applicable. For example, where the prize contains ticket(s) to an event, you will not only be bound by the Specific Rules and General Terms and Conditions, but also the event organiser and venue owner’s rules and terms and conditions.
8. COMPETITION DURATION AND WITHDRAWAL
The Kinetic Foundation may, in its absolute discretion, vary or withdraw a Competition, Specific Rules or the General Competition Terms at any time. You agree that no liability shall attach to the Kinetic Foundation as a result thereof.
9. NO ENDORSEMENT
Your participation in the Competition, including being selected to receive the prize, in no way constitutes an endorsement or support by the Kinetic Foundation of your views or aims or of any products or services. You shall not advertise or otherwise claim to have obtained any such endorsement or support.
Where a Competition is run on one or more of the Kinetic Foundation’s social platforms or a third party's platform, that Competition is in no way sponsored, endorsed or administered by, or associated with that social media platform or third party platform. You acknowledge that any such social media platform or third party (as applicable) shall have no liability to you in connection with that Competition.
10. INTELLECTUAL PROPERTY
The Kinetic Foundation’s name and logo are the property of the Kinetic Foundation and should not be used in any manner whatsoever without the prior consent of the Kinetic Foundation. The Kinetic Foundation must approve in writing any statement, advertisement, press release or similar communication in any media (including any social post, blog or any other type of self-publishing platform) relating to your participation in the Competition.
11. LIABILITY
The Kinetic Foundation’s name and logo are the property of the Kinetic Foundation and should not be used in any manner whatsoever without the prior consent of the Kinetic Foundation. The Kinetic Foundation must approve in writing any statement, advertisement, press release or similar communication in any media (including any social post, blog or any other type of self-publishing platform) relating to your participation in the Competition.
12. PERSONAL DATA
By entering the Competition, you consent to the storage, transfer and use by the Kinetic Foundation and its affiliates of any personal data that you supply, for the purpose of administering and managing the Competition and the prize. The Kinetic Foundation will use, process and store your personal data in accordance with the the Kinetic Foundation Privacy Policy and in accordance with the General Data Protection Regulation 2016/679.
The Kinetic Foundation may hold your personal data for a period of 2 years in order to comply with our regulatory obligations.
13. GOVERNING LAW AND JURISDICTION
The Specific Rules and General Competition Terms, and all matters related to them including any dispute or claim arising out of or in connection with them, are governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the courts of England and Wales.
